The Space

The home is designed keeping in mind the needs of the entire family. It offers an ideal space for working from home, there is high-speed 1GBPs internet throughout the house. Or to just kick back and relax.

LIVING/DINING:

As you enter the home, you will be welcomed into a spacious and stylishly done living/dining area with the classic Country stove fireplace. The living/dining area includes a modern solid wood 8-person dining table. If you need more seating there are additional chairs in the garage. There are also two medium-sized couches with total seating space for 6 people.

KITCHEN:

Adjacent to the living/dining area is the well-equipped kitchen with granite counter tops, updated stainless steel appliances (stove, refrigerator, dishwasher, microwave, electric kettle), a Keurig coffee maker, traditional coffee maker and an adequately-stocked kitchen complete with dishes, glassware, baking and serving ware and cookware.

ENTERTAINMENT ROOM:

Next to the kitchen is the Entertainment Room, where you will find options for the entire family to enjoy. There is a 70" LG LED TV, with comfortable theatre-style seating for 7 (4 leather recliner chairs and 3 floor gaming chairs). Please note that we do not have cable TV. It's a smart TV, you can log into Netflix, HULU, Disney+ etc. through your own account. The media console stores multiple board games. We also provide an XBOX with two controllers.

PATIO

Beyond the living/dining area is the patio that is nestled in the woods. You can peek at calming, open views of the Trout Creek Meadow. Enjoy the sunrise or sunset as you kick back on the patio while taking in the serene surroundings.

FITNESS/SPA AREA

This is our favorite area in the house. Start or end your day with a rewarding workout on the Peloton, stretch on the solid pinewood Swedish Ladder, meditate in the fitness room while staring out of the large window, relax in the sauna or take a dip in the hot tub in the spa room adjacent to the fitness room.

Kids (ages 5-12) will enjoy the Swedish Ladder as the perfect indoor gym. We would know. :-) Our kids, ages 6 and 9, love the rope ladder, rope swing, trapeze and horizontal bars (Only under strict adult supervision).

This area of the house provides an experience that is not to be missed.

BEDROOMS:

There are 5 bedrooms and 4.5 bathrooms in the house. Each room has been thoughtfully designed with seclusion and comfort in mind.

Bedroom 2 Upper floor. King bed. Work Desk and chair. Wall-mounted 43" flat-screen TV. Attached full bath.

Bedroom 4 Ground floor. Two single beds that can be joined to make a king bed. Work desk and chair. Full bath across the hallway.

Bedroom 5 Lower Floor. Queen bed. Work Desk and chair. Half bath across the hallway.

GARAGE / PARKING:

You will arrive at a leveled parking area with same-level access to our single-family, three-story home. There are 2 small steps to enter the main house. There is enough space to park up to 5 cars. You can park 2 cars inside the garage and 3 cars in the driveway.

The Location

The house is in Tahoe Donner in the town of Truckee. Tahoe Donner is a quiet neighborhood. Most of the guests in this area are engaged in outdoor activities during the day and stay in at night. The house is close to downtown Truckee, all of Tahoe Donner’s amenities, Donner Lake, Lake Tahoe and several world-class ski resorts. Everything you would want to see and do is within 20 miles or less. You will also have privacy and seclusion, so the best of both worlds!!

Guests have access to the Tahoe Donner HOA amenities for a small fee with owner-provided GUEST ACCESS cards, up to 8 adults and kids older than 7 years. Children that are 7 years and younger are free. Public and Private amenities include the Beach Club Marina, Bikeworks, Campground, Downhill Ski Resort, Equestrian Center, Golf Course and Driving Range, Tennis Center, Snowplay, Hiking Trails, Trout Creek Recreation Center, Recreation Hut and Private Dock.

There are 2 GUEST ACCESS cards kept in the Entertainment room under the TV, each card admits 4 guest each. Please return these cards back to the Entertainment room. Guests will be responsible for a replacement fee if they take the cards with them. Before you book, please check Tahoe Donner website for current availability of amenities as they change seasonally. No refunds will be given if amenities and/or ski resorts are closed or unavailable for any reason.

The Nitty Gritty

***RENTAL AGREEMENT/SECURITY DEPOSIT***

Please note that all guests will receive an email required to sign our rental agreement that lists the house rules (listed below). We need you to sign it and share your credit card info through our secure reservation system for a $500 deposit. It's important that you review and sign this agreement within 48 hours of receipt to maintain your booking. If this step is overlooked, your reservation may be subject to automatic cancellation as per our house rules. We would not want that to happen, so we emphasize this to ensure all goes smoothly with your reservation.

The reason for the agreement is simple - it is in place to provide transparency and protection for both our valued guests and us, the hosts. The security deposit is simply a temporary hold on your card, not an actual charge, although it will count towards your credit limit. This means your money stays in your account. We put this hold on your card one week before you arrive. If there's no damage when you leave, we'll remove the hold one week after you go.

***HOUSE RULES***

1. VEHICLE: Guests will ensure that all vehicles in the group are 4-wheel drive during the winter/snow season (November to May). Otherwise guest runs the risk of having issues en-route or on our sloped driveway, which can be slippery/icy. Guests are allowed a maximum of 5 cars at the property. No parking on the street. Only park on the driveway or in the garage.

2. PARKING: Guest will NOT park any cars on the street, particularly when it snows. Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

3. PETS: Home is pet friendly but pets are NOT allowed without prior approval from the Owner. Owner may approve a pet with an additional fee on a case-by-case basis if Guest reaches out us BEFORE making their booking. If guest has a service animal, guest must inform us BEFORE making the booking and the service animal must be house broken and have supporting service-animal documentation. If guest attempts to sneak in a pet of any kind without informing Owner, guest will be charged an additional $500 fine and be asked to leave promptly with no refund. No more than two pets at any given time. If the pet is approved by the Owner, the following rules must be followed at all times (without exception) Pet(s) must be house-broken. Pet(s) must not go up on any furniture (as Owner hosts people with allergies). Guest will travel with their own pet's bed. Pet(s) must not be left alone at home, unless left in a crate.

4. NO SMOKING/VAPING/HOOKAH: There is absolutely NO smoking/vaping/hookah inside or outside the house. Guest understands that they are in a wooded area and fire is a real threat here. Violation will result in a $1000 fine.

5. GUESTS: The property shall not be used by more than the number of adults and children listed in the reservation. Any visitors, even if they are not staying the night, that are not included in the online reservation will be cause for immediate eviction without refund. An adult 25 years or older must be present at all times

6. NOISE/PARTIES: If Guest plans to throw a party they should not book this home. This is the Owner's home and they use it regularly. Guests must treat it with respect. Tahoe Donner HOA requires no noise outside after 10PM. It is best if Guests stay indoors during these hours. Guests must not play music outdoors after 10 PM. Remember, sounds carry easily in the mountains and even a group of few people talking and laughing can be construed as a “loud party” by our neighbors. A single warning will result in hefty fines and severe penalties, so Owner ask that Guest take this rule very seriously. If Owner learns of a noise issue, the police will be called and Guest will be asked to leave with NO refund of monies paid and, if warranted by damages, criminal charges may be filed by the homeowner. Violations will be subject to a $1,000 fine, or such amount as levied by the Tahoe Donner Association on homeowners and/or guests that violate this rule.

7. WEATHER ISSUES: Guests acknowledges that no refunds will be given for storms. Mountain roads can be curvy and steep. Neighborhood roads are well maintained; however, 4-wheel drive and/or chains during the winter months may be required. Owner does not refund due to road conditions. There will be no refunds or compensation for events out of the homeowner’s control including but not limited to: Acts of God, Mother Nature, acts of war or government agencies, road maintenance, gas shortages, power outages or water outages, construction or maintenance work in the vicinity, equipment failures, snow and road conditions, business closures and area event schedule changes. NO GUARANTEE OF SNOW OR WEATHER CONDITIONS, ROAD CONDITIONS, POWER, CABLE, INTERNET, OR TELEPHONE OUTAGES. Owner highly recommends that guests purchasing travel insurance (preferably Cancel For Any Reason (CFAR)) to avoid losing their vacation investment due to unforeseen circumstances that are out of the homeowner's control.

8. FURNITURE: Guest will NOT rearrange the furniture. Doing so will result in an additional $200 fee. Keep the property and all furnishings in good order, removing any items from the cabin including furnishings and appliances is not permitted.

9. DAMAGE: Any damage to any items in the cabin including couches, chairs, tables, TVs, pool table, hot tub, sauna, fitness room, beds, sheets, towels, pillows, etc., are the responsibility of the guest. Every item will be looked at before arrival and after departure.

10. SUPPLIES: Owner will stock the cabin with starter supplies but guest will likely need to supplement with their own supplies during their stay. Owner cannot guarantee a full propane tank for the grill. Guests are responsible for getting their own propane. Safeway or ACE Mountain Hardware are good, and closest places to get propane.

11. TRASH: Guest will comply with the garbage instruction per the check-in and check-out instructions, including but not limited to ensuring that all garbage must be placed INSIDE the rubber trash bins that are inside the bear-box, located near the driveway, or INSIDE the house in the kitchen or garage trash can. Guest will not let the rubber trash bins overflow. The lid on the rubber trash bins must be able to close completely shut. Guest will NOT leave trash outside of the bear-box or in the car. THIS WILL ATTRACT BEARS and possibly other animals. Bear-box trash pick-up is Tuesday at 6am. Violations will be subject to a $1,000 fine, or such amount as levied by Tahoe Donner on homeowners and guests that violate this rule.

12. PLUMBING: Guest will NOT FLUSH anything other than toilet paper. No feminine products or baby wipes should be flushed at any time. If it is found that feminine products or wipes have been flushed and clog the plumbing system, guest could be charged damages of up to $1000.

13. KITCHEN: Only use appliances for their intended uses. No grease in the sink.

14. HOUSEKEEPING: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. There is a washer/dryer in the house for guest’s use. Owners do not permit towels or linens to be taken from the units.

15. TV & REMOTES: Guests keep the remotes in their designated storage areas. $50 fine for each lost remote.

16. FIREPLACE: The fireplace is a wood burning fireplace. Guests will not throw any paper or other combustible materials in the fireplace. When the fireplace is not in use, and there are no burning embers, the chimney flue must be kept in the closed position. California’s fire season runs from approximately June 1 – Sept 30. Wood burning stoves should only be used seasonally from October 1 through May 31.

17. FIRES: Absolutely no fires! Unauthorized fires (including candles) will be charged $1000 fee plus damages.

18. GRILLS: Guests will not empty hot ashes from the grill onto the ground or into a plastic bag.

19. CAMERAS: Owner cares about guest's security and respect their privacy. There are 3 exterior cameras and noise sensors for security reasons. There are absolutely NO cameras pointing towards the indoor living spaces. The exterior cameras are located 1) Outside the front of the house over the garage door 2) Outside the front door and 3) Outside looking over the backyard. The cameras will be recording constantly 24/7 and will be recording during the guest reservation.

20. MAINTENANCE OR HOUSEKEEPING: The house is provided as is, and Owners are not responsible for nor are they required to provide any refunds for the inoperability or unavailability of any amenities or for any housekeeping problem. The Guest will contact the Owner as soon as they notice any maintenance or housekeeping problem. Owner will take reasonable and appropriate steps to remedy any reported problem as soon as practical. If timely repair/replacement is not possible, Owner may — but is not required to — issue partial reimbursements to Guest. Partial refunds, such as a 5% refund for an unusable hot tub or sauna, will be at the Owner’s discretion.

21. GENERAL HOT TUB, SAUNA AND FITNESS ROOM RULES - Responsible adult supervision is the key to safety. Guest will not ever leave anyone in the hot tub, sauna or the fitness room alone without checking on them on a regular basis. There should always be an adult designated to maintain constant visual contact with children especially whenever they are near, or could get near, any body of water. When using the hot tub, sauna or fitness room, Guest acknowledges that there is a certain health risk associated with this facility. Guest uses at their own risk. The Owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Owners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

22. BEFORE USING THE HOT TUB OR SAUNA: A shower must be taken before entering. NO glass containers, oils, creams, candles, or fires are allowed. Guest agrees to use the cups provided on the shelf in the fitness room. Guest to limit hot tub/sauna time to 15 minutes at a stretch. Children under 16 should not use a hot tub or sauna. Children are smaller and their temperature will rise quicker than an adult. Babies' thin skin makes them more susceptible to overheating. All guests should be encouraged to drink fresh water while they're soaking. If the bather feels sick to their stomach, dizzy and/or sleepy, they should exit the spa immediately. - Guest is not allowed to use the hot tub or sauna if consumed excessive alcohol. Jumping in the hot-tub is not allowed. Diabetes, high or low blood pressure and other illnesses could affect hot tub use – know about the hot tub safety guidelines for these conditions. Medications that cause drowsiness can cause complications with hot tub use. People with allergies to water treatment chemicals, pregnant women, persons with heart conditions or skin sensitivities should NOT use a hot tub or sauna. The maximum capacity of people at a time in the sauna or hot tub is 6.

23. AFTER USING THE HOT TUB OR SAUNA: A shower must be taken after using the hot tub or sauna. It is OK have the windows open when guests are in the room to reduce the humidity level. Guests, must leave both windows in the hot tub room CLOSED when not in use. Guests must make sure that the sauna light and heater are SHUT. Guest must SHUT ALL doors completely and leave exhaust ON at all times. At the end of the day, Guest will add 1 spoon of chemical provided for every person that used the hot tub.

24. SWEDISH LADDER RULES - The Swedish Ladder or Stall bar was pioneered in Sweden during the early 1800s by Per Henrik Ling, founder of the Swedish Royal Gymnastic Central Institute. He was also a pioneer of physiotherapy and gymnastics. It is used for strengthening, stretching and resistance training. Centuries of development and verified benefits leave no doubt as to their effectiveness in the rehabilitation and improvement of the human body. The Swedish Ladder should only be used by kids aged 5 to 12 years old. No person using the Swedish ladder may exceed 100lbs in weight. Only ONE person can use the Swedish ladder at one time. On site ADULT supervision and support must be provided at all times. Guest must check the structure before using. If the structure does not feel secure, the Guest will NOT use the Swedish Ladder. Guest will ALWAYS use the Swedish Ladder with the provided fall protection mat. There is a $750 fee if the above rules are not followed or if the Swedish Ladder is found to be broken or abused for any reason by the Guest. Guest acknowledges that there is a certain health risk associated with this Swedish Ladder. Guest uses at their own risk. The Owners are not responsible for any accidents, injuries or illness that occurs while using the Swedish Ladder. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the Swedish Ladder or others whom they invite to use the premise.

25. TAHOE DONNER AMENITIES: Guests have access to the Tahoe Donner HOA amenities for a daily fee, up to 8 adults and kids older than 7 years. Children that are 7 years and younger are free. Public and Private amenities include the Beach Club Marina, Bikeworks, Campground, Downhill Ski Resort, Equestrian Center, Golf Course and Driving Range, Tennis Center, Snowplay, Hiking Trails, Trout Creek Recreation Center, Recreation Hut and Private Dock. No refunds will be given if amenities and/or ski resorts are closed or unavailable for any reason.

26. WILDLIFE: Lake Tahoe is home to many different types of wildlife including but not limited to Bear, Deer, Squirrels, Mice, Chipmunks, Yellow Jackets, Carpenter Ants, Spiders, Flies etc. Guests may encounter wildlife at anytime and anywhere during their stay. NO REFUND OR REBATE will be offered in connection with any wildlife encounters. Guests will practice bear safety precautions at all times. Owner has cabin treated by a professional exterminator periodically. That said, the cabin is in the woods and guests will see and hear critters, creepers and crawlers. GUESTS WILL SHUT ALL EXTERIOR DOORS TO PORCH AND FRONT OF HOUSE BEHIND YOU.

27. GENERAL HOLD HARMLESS AGREEMENT: Guest shall be liable for the actions of all occupants, visitors or other persons on the Property. In the event of injury or death to Guest, Guest’s dependent, self, or any other person or minor staying at or visiting the Property. Guest hereby releases, holds harmless and agrees to fully indemnify Owner(s) and their agents, heirs and assigns from any and all lawsuits, damages, claims or other expenses, including accidental death sustained by Guest, Guest’s dependent, self, or any other person or minor staying at or visiting the Property, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the Owner. In addition to this general release, Guest acknowledges that specific hold harmless provisions may be attached to this Agreement. Guest agrees that if specific hold harmless provisions are attached to this Agreement, they are incorporated into and made part of this Agreement. Guests agree to hold Owner harmless as to any damage or injury to self or property resulting from accident, injury, or loss due to rain, snow, sale of property, flood negligence, fire, theft, construction or other reasons. 23.

28. HOLD HARMLESS PROVISION: HOT TUB, SAUNA AND FITNESS ROOM. Guest acknowledges that a hot tub, sauna and fitness room has been made available. Guest acknowledges the risks associated with a hot tub, sauna and fitness room. Hot tubs, sauna and fitness rooms can be dangerous especially to the young, elderly, pregnant and physically infirm. Risks are many and include, but are not limited to: drowning, overheating, stroke, dehydration, slipping and falling. Use of the hot tub and sauna should be limited to a maximum of 15 minutes per use; significantly less or none for the young, elderly and physically infirm. For health and safety reasons, persons under the age of 18 must be accompanied by a parent, guardian, or legal custodian, or someone who is 18 years of age or older, and who is authorized by parent, guardian or legal custodian to supervise such child. The accessibility of the hot tub, sauna and fitness room has been fully explained to Guest, and Guest, not Owner, agrees to accept responsibility for regulating the use of the hot tub, sauna and fitness room, including any use or prevention of use by children and the elderly and infirm. Guest understands that the risks described here and other inherent risks could cause injury and death and Guest freely assumes those risks. Guest has, or will before use, explain these risks and this provision to all persons on the Property during Guest’s stay. 24.

29. SEVERABILITY: Guest further expressly agrees that the foregoing waiver(s) and assumption of risk provisions is/are intended to be as broad and inclusive as is permitted by law and that if any portion thereof is held invalid, it is agreed that the balance shall continue in full force and effect.

30. TAHOE DONNER HOMEOWNER’S ASSOCIATION Guest agrees that they are aware that the property is located at: is located within a community that is governed by a Homeowners Association. Guest also understands that it is their responsibility as a renter of the residence within Tahoe Donner Association to follow all rules and regulations governing the residence and Tahoe Donner Association property and facilities. Guest understands that the Owner of the residence is required to comply with the Tahoe Donner Association rules and regulations which includes providing a copy of the rules at the time of booking and advise the renting party of the obligation to follow the rules. Additionally, owners are required to make available at the residence the following: • Tahoe Donner Association Covenants and Restrictions • Tahoe Donner Association Covenants Rules • Tahoe Donner Association Evacuation Map

31. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind.

32. In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval by Owner. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair. If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification.

33. In the event Guest wishes to terminate this agreement, Travel Insurance, Damage Protection and any processing or administrative fees are non-refundable. The refund policy is as follows:

34. A payment of {BFPPOA} is taken by Owner at the time of the booking. Any remaining balance must be paid {BSPDAY} days prior to the arrival date, or this Agreement may be cancelled by the sole option of the Owner. An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made {BSPDAY} days prior to the arrival date. The credit card of the first payment is used if a credit card was provided. If the automatic payment fails for any reason, it is the responsibility of the Guest to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments made. All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person. Any refunds due to Guests from a credit card payment will be refunded by credit card transaction; all other refunds will be made within 30 days by check.

35. A security deposit is required ("Security Deposit") and will be automatically reserved for the booking. The automatic reserve is conducted by putting a hold or charge on the Guest's credit card for the amount of {BSDAMT} exactly {BSDRS} day(s) prior to the arrival date. The credit card of the last successful payment will be used. If there are no successful credit card payments, it is the responsibility of the Guest to send {BSDAMT} by check to the Owner to satisfy the Security Deposit requirement. If, at the end of the rental period, the rental property is returned undamaged beyond normal wear and tear, the Security Deposit will be released in full within {BSDRL} days. In the event of any damages, Owner will provide Guest with a full accounting of expenses incurred and deductions made from the Security Deposit. Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within {BSDRL} business days after receiving notification. Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, hot tub draining and refilling fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, or other service call fees. Owner is under no obligation to use the least expensive means of restoration.

36. Regular payments and security deposits for the booking will be displayed as {PCCSTEXT} on the Guest's credit card statement.

37. No refunds will be provided due to inoperable appliances, sauna, hot tubs, etc. The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god or nature.

38. There is no land-line telephone on the property.

39. Guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest. Items found and not claimed within 30 days will be disposed of at the discretion of Owner.

40. If a hot tub or sauna is provided at the Rental Property, it will be prepared and tested for proper and safe chemicals prior to or on the day of occupancy. Misuse of a hot tub or pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of Owner. Under no circumstances are pets allowed in pools or hot tubs. Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid.

41. If linens or towels are rented from Owner or supplied with Rental Property, Guest is responsible for lost or damaged items at the cost of two (2) times the published standard rental price for such damaged or lost linens or towels.

42. In the event Owner is unable to make Rental Property available for any reason other than described above or a reasonable substitute as determined by Owner, Guest agrees that Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the phone, spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.

43. Owner may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.

44. Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.

45. The Rental Property may offer access to recreational activities, including but not limited to hot tub/spa, sauna, exercise room and equipment Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.
